Aditya Birla Fashion and Retail Limited (ABFRL) has been accused of “disobeying” the court’s order regarding its patented products by Yashram Lifestyle, a retailer that focuses on products and services for women. Yashram Lifestyle has filed a contempt plea against ABFRL in the Karnataka High Court.
On September 25, the Karnataka HC had allowed an outright directive limiting ABFRL from assembling or selling sterile underpants protected by Yashram Way of life Brands beginning around 2009.
Yashram Lifestyle, on the other hand, asserts that ABFRL has been “wilfully disobeying” the absolute injunction and that the company has continued to manufacture, market, and sell the infringing products on its e-commerce website as well as through a number of other channels.
Detention of all the personnel who are involved in the day-to-day affairs of the company in civil prison for willful disobedience and breach of the order,” Yashram Lifestyle requested in its plea, in addition to the attachment of ABFRL’s assets.
“It’s been disappointing to witness such blatant disregard for the law,” said Deepa Kumar, managing director of Yashram Lifestyle Brands. I must fight for my legally granted right by the Indian government. The battle is not easy, but it must be fought. It is unfortunate that I was forced to file a contempt of court complaint against a company that I have always admired.
A representative for ABFRL told CNBC-television in an explanation, “We are recording an allure in the court in no time. In any case, in the in the mean time we have trained our business to follow the court request.”
According to Yashram Lifestyle, the hearing is anticipated to take place on October 29.
