\n\uf0d8 Fiat Chrysler Automobiles – Fiat Chrysler Automobiles is an Italian-American multinational corporation primarily known as a manufacturer of automobiles, commercial vehicles, auto parts and production systems.
\n\uf0d8 Jeep – the Jeep brand is part of the multinational automaker Fiat Chrysler Automobiles (FCA). jeep’s current product range consists solely of its sports utility vehicles and entirely off-road SUVs models.
\n\uf076 CASE DETAILS –
\nAfter the Second World War, Mahindra through an agreement with jeep.
\nThe agreement is, that Mahindra will manufacture utility vehicles based on the iconic design Willys Jeep ONLY FOR THE INDIAN MARKET.
\nFor that Mahindra, India has a licence.
\nMahindra is building a long line of Jeep-inspired vehicles in India both Mahindra & Jeep are selling it.
\nBut In 2020 A test mule of the Thar was spotted in Australia, Mahindra also housed a \u2018Register Your Interest\u2019 page for the new Thar and new teaser was posted on their website.
\nAfter the launch of the new teaser, Jeep filed a case in the FEDERAL COURT OF AUSTRALIA.
\nJeep claims that the Mahindra has heavily copied Jeep Wrangler and infringed the agreement.
\nAfter the case was filed Mahindra immediately stopped activities related to the import, distribution and sale of the product in Australia.<\/p>\n
\uf076 RESULT OF THE CASE-
\nJeep won the case in Australia Federal Court.
\nA federal court gave the statement that the Mahindra Thar hood latch is a replica of the iconic trade dress of the Jeep brand, Calling it “Inspiration”. And Mahindra was asked to concede and undertake that they will not import or sell the current Thar vehicle in Australia and will provide prior notice to FCA before bringing any future model or variant of the Thar into Australia.
\n\uf076 STATEMENT BY MAHINDRA –
\nMahindra conceded by making a clear statement – We\u2019re seeing very strong demand for the all-new Thar 2020 in India, therefore have no immediate plans for the launch of the current variant of the Thar in markets outside India. As a result, it was pointless to engage in litigation at this stage. When we decide to launch any new variant of the Thar in Australia, we will provide 90 days\u2019 notice to FCA and take all steps to protect our rights to market and sell the product.<\/p>\n
